29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address the PHA team's findings and recommendations: (a)AMTEC Corporation DBA Tech Ord at 47600 180th Street in Clear Lake, SD 57226: On or about and at times prior to October 10, 2022, the company did not promptly address recommendations related to manual rebowling of primary explosives covered in the Process Hazards Analysis Report for Primary Explosive Processing PHA 0046. This condition exposed employees to explosion hazards associated with manual rebowling of primary explosives. In the alternative: OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion hazards: (a)AMTEC Corporation DBA Tech Ord at 47600 180th Street in Clear Lake, SD 57226: On or about and at times prior to October 10, 2022, the company did not ensure employees were protected from explosion hazard when rebowling of NOL-130, a primary explosive, in that rebowling was performed manually requiring employees to expose their arms and hands in the blast zone. This condition exposed employees to explosion hazards. Among other methods, recognized and feasible means of abatement for this hazard include; Comply with the DOD Contractor's Safety Manual For Ammunition and Explosives DOD 4145.26-M March 13, 2008 Section C.13.8.11. Rebowling Operations. Rebowling operations involving primary explosives or primer mixes shall be performed.
