29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200): a) BAPS Northeast-Front Lot, 100 North Main St, Robbinsville, NJ 08691: The employer did not ensure that a program was in place when the employees were performing work involving the mixing of cement for curb work and creating dust containing crystalline silica. Occurred on or about September 23, 2022. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
