Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards from a dump truck tip-over while operating a tandem axle dump trailer with a full load of fill dirt. (a) The Jobsite at 145 Commerce Dr., Warwick RI: On or about September 16, 2022, the employer exposed employees to struck-by and crushed-by hazards from a dump trailer tip-over hazard while operating a tandem axle dump trailer with a load of fill dirt that was positioned parallel to the uneven downward slope of the terrain, causing the dump trailer to tip over onto a Caterpillar 980K front-end loader.
