29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) An employee was hospitalized with COVID-19 on July 24, 2022. The employer was notified on July 25, 2022, but the incident was not reported to OSHA until July 27, 2022. The Department of Veterans Affairs dba Dayton VA Medical Center was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1331674, citation number 1, item number 1 and was affirmed as a final order on 09/15/2018, with respect to a workplace located at 4100 W. Third St., Dayton, OH.
