29 CFR 1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part, in that employees were not protected from the hazard of high ambient heat while performing jobs duties. (a) On or about May 11, 2022, an employee, working in direct sunlight was exposed to the hazard of excessive ambient heat while performing carpentry work. For the duration of the work shift (up to six hours), the average heat index was 87 degrees Fahrenheit, with a peak heat index of 95 degrees Fahrenheit. The employer had not initiated a heat stress illness prevention program to ensure that employee(s) were gradually introduced to the full working conditions and arrange for a formalized work/rest schedule.
