Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to caught-in and amputation hazards: (a)Dakota Layers, LLP at 22252 South Dakota Highway 13, Flandreau, SD 57028: On or about and at times prior to June 12, 2022, the employer did not ensure that employees were protected from caught-in or amputation hazards when working near the fan blades on the 48-inch High-Capacity Hemisphere Fan Assembly, Part Number: 972180-Q4 and its chimney inlet. An employee working near this equipment was seriously injured when his foot was caught in the blades of the fan. Abatement Note: Among other methods, feasible and acceptable methods to correct this hazard are to ensure that a guardrail or travel restraint system is installed to prevent access to the area; or that the hemisphere fan assembly is completely guarded; or that a lock-out/tag-out process is implemented to ensure all energy to the fan is shut down when employees are working in this area.
