29 CFR 1910.29(b)(2)(i): The employer did not ensure that guardrails met the requirement that midrails that are installed at a height midway between the top edge of the guardrail system and the walking-working surface: A. Main Tower, Roof Access Stairs: On, or about, June 16, 2022, the upper stair landing provided for the fixed stairs was not provided with a midrail or equivalent member. B. Main Tower, Roof Access Landing: On, or about, June 16, 2022, the midrail provided in the guard rail system installed at the roof landing for the access stairs was installed higher than "midway" between the top rail and roof level, which left a larger opening between the midrail and roof surface. Abatement Note: The roof access stairs and landing should be reconfigured to not require employees to navigate down a set of steep stairs onto a membrane roof in close proximity to the roof edge. As an interim measure, in addition to lowering the midrail, a toeboard or other solid member should be added to the existing guardrail to fill the gap(s) between railings to offer a more positive stop in the event that an employee slips at the lower stair landing.
