OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Lynn's Inc. dba Taco John's at 24327 US Highway 212, Eagle Butte, SD 57625: On or about and at times prior to April 16, 2022, the employer did not ensure employees were protected from burn hazards when moving the Atosa 40-pound Deep Fryer Model ATFS-40 fryer to accommodate cleaning and other activities in that (1) the casters on the appliance were not ensured to be capable of secure attachment and (2) the fryer was not appropriately restrained to prevent spilling of hot liquid. One employee suffered 2nd and 3rd degree burns to their left foot from contacting hot cooking oil from the Atosa 40-pound Deep Fryer Model ATFS-40 after the appliance tipped over. This condition exposed employees to burn hazards. Among other methods, recognized and feasible means to reduce employee exposure to burn hazard related to operation of oil fryers include: ? Ensuring that fryers components comply with CSA/AM ANSI Z83.11-2016/CSA 1.8-2016 - Gas food service equipment Section 4.4.2: Legs and Casters shall be capable of secure attachment to the appliance (Page 39). o For the Atosa 40 lb Deep Fryer Model ATFS-40, among other methods, this may include the following conducted by a qualified technician in compliance to any applicable manufacturer's guidance: ? Utilize an alternative style of caster that has a lower exposure to rotational loosening, such as plate casters. ? Secure existing casters to the appliance by spot welding. -and- ? Comply with CSA/AM ANSI Z83.11-2016/CSA 1.8-2016 - Gas food service equipment Section 4.47.1.x: Ensuring the fryer is restrained to prevent tipping to avoid the splashing of hot liquid. The means of restraint may be the manner of installation, such as connection to a battery of appliances or installing the fryer in an alcove or by separate means such as adequate ties.
