29 CFR 1926.1053(b)(1): Where portable ladders are used for access to an upper level landing surface and the ladder's length do not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladders are not secured at its top to a rigid support that will not deflect, and/or a grasping device is not provided to assist employees in mounting and dismounting the ladders. (a) The employer does not ensure that ladders are setup to extend at least 3 feet above the upper landing area. This violation was most recently observed at 1307 Mount De Chantal Rd, Wheeling, WV, where on or about March 29, 2022, employees were accessing the 1st story roof using a fiberglass reinforced plastic (FRP) extension ladder which did not extend at least 3 feet above the upper landing surface, exposing employees to fall of up to 10 feet. (b) The employer does not ensure that ladders are setup to extend at least 3 feet above the upper landing area. This violation was most recently observed at 1307 Mount De Chantal Rd, Wheeling, WV, where on or about March 29, 2022, employees were accessing the 2nd story roof using a fiberglass reinforced plastic (FRP) extension ladder which did not extend at least 3 feet above the upper landing surface, exposing employees to fall of up to 10 feet. Charm Builders was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1530421, citation number 3, item number 3 and was affirmed as a final order on 12/29/2021, with respect to a workplace located at 1021 Mount De Chantal Rd, Wheeling, WV. Charm Builders was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1253476, citation number 1, item number 4 and was affirmed as a final order on 9/4/2018, with respect to a workplace located at 47 2nd Street NE Massillon, OH 44646.
