29 CFR 1926.1427(c)(1): Licensing. When a state or local government issues operator licenses for equipment covered under subpart CC, and that government licensing program meets the requirements of 1926.1427(c)(1)(i), the employer did not ensure the equipment operator was licensed by that government entity for operation of equipment: a) Front of building, South side parking area - On or about March 17, 2022 and at times prior thereto, the employer did not ensure that the Effer 170 5S knuckle boom crane operator had been certified/licensed by NYS Department of Labor to operate such equipment. On March 17, 2022 the crane operator was fatally crushed by the boom of the crane while standing at the operators controls.
