29 CFR 1926.702(j)(1): Employees were permitted to perform maintenance or repair activity on equipment (such as compressors, mixers, screens, or pumps used for concrete and masonry construction activities) where the inadvertent operation of the equipment was not eliminated by use of lock out/tag out procedures: a. On or about November 29, 2021, an employee was manually/ using his hands to unclog a concrete pump, that which was found to have been missing three of its safety guards, and during which time the employer failed to prohibit such activities, and wherein the employee did not use lock out/ tag out procedures to eliminate the inadvertent operation of the concrete pump; therefore exposing the pump operator/ employee to an amputation hazard.
