OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards when using chain saws to cut moving extruded pipe on Line 3. (a)Pipeline Plastics, LLC at 10805 US Highway 212 in Belle Fourche, SD 57717: On or about and at times prior to March 1, 2022, the employer did not ensure employees were protected from caught-in hazards associated with chainsaw kickback, pull-in and push-back. Employees utilized a Husqvarna 455 Rancher X-Torq chainsaw to cut moving extruded pipe on Line 3 due to the Battenfeld-Cincinnati CutStream PTA 400 3801166-140 pipe saw being inoperable. Cutting moving pipe on the extrusion line increased the risk of the pipe closing in on or pinching the saw blade during cutting due to compressive forces on the pipe from extrusion and cutting during lateral movement of the pipe. Pinching or closure of a workpiece on a saw blade can cause chainsaw kickback, pull-back and pull-in. This condition exposed employees to caught-in hazards. Among other methods, recognized and feasible means to reduce compressive and lateral forces exerted on the Husqvarna 455 Rancher saw chain that can cause kickback, pull-in and pushback hazards when cutting moving extruded pipe on Line 3, include: 1). Use of a chainsaw pipe clamp configured in a manner that prohibits rotational kick-back, pull-in and pushback. -and- 2). Ensure employees do not stand directly behind the saw when cutting. -or- 3). Use of the Battenfeld-Cincinnati CutStream PTA 400 3801166-140 to cut extruded pipe on Line 3.
