OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment, or a place of employment, which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that there was no program in place to ensure employees were effectively trained on the safe operation and use of utility vehicles: Employer did not ensure that procedures were provided on the safe operation of utility vehicles in the following instances: a) EVENT CENTER PAVILION: On or about February 25, 2022 and at times prior to, the gate arm and strap used to block traffic was not fully retro-reflectorized with vertical stripes running along the top for its entire length, exposing employees to serious injury from struck-by hazards from unseen portions. b) EVENT CENTER PAVILION: On or about February 25, 2022 and at times prior to, the employer did not develop or implement a traffic control plan that included procedures for notifying workers of temporary changes in traffic patterns, exposing employees to serious injuries from struck by hazards.
