29 CFR 1926.20(b)(1): The employer does not initiate and maintain such programs as may be necessary to comply with this part: a) The controlling employer, Biltmore Company, LLC, does not maintain an effective accident prevention program to address hazards to which their employees and employees of their sub-contractors are exposed. Hazards include but may not limited to; the framing sub-contractor not using personal fall protection or personal protective equipment when needed. These conditions were most recently observed at 4783 Summit Way, Meridian, ID, 83646 on February 9, 2022. Biltmore Company, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1312168, citation number 2, item number 1a, and was affirmed as a final order on August 8, 2018 with respect to a workplace located at 3030 Owyhee Park, Boise ID. Note) Pursuant to 29 CFR 1903.19, Biltmore Company, LLC must submit certification and documentation of specific actions taken to ensure a competent Biltmore Company supervisor is on the jobsite who can maintain and effectively implement an accident prevention program that requires compliance by its sub-contractors and provides for consistent, meaningful enforcement of the program.
