Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a front end loader. On or about 10/30/2021, on the concrete pad, the Caterpillar model 924H front end loader, serial number C6E22487J2Y03029, was operated with damaged equipment, such as but not limited to shattered window and inoperable lights, horn, and windshield wipers to move charcoal from the kilns to the pad.
