Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing/struck-by hazards: (a) On or about October 15, 2021, at or near 15th Street SE & Rollin Avenue SE in Cooperstown, North Dakota, for the employee exposed to crushing/struck-by hazards resulting in a fatality while conducting asphalt paving operations. Note: Among other methods, one feasible and accepted method to correct this hazard would be to follow the requirements contained within ANSI/ASSE A10.47 - 2015 Work Zone Safety for Highway Construction; to ensure that all equipment and personnel moving within the work zone do so in a manner to maximize the separation of vehicles and pedestrians through the use of an internal traffic control plan, the use of spotters when backing vehicles and equipment within the work zone, equipment being equipped with backing alarms and the wearing of high visibility apparel.
