29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a. The employer fails to ensure portable ladders used for access extend at least 3 feet above the upper landing surface as demonstrated on or about 10/16/2021, at Lot #4 James Taylor Road, Moody, Alabama when the ladders used by employees for accessing the roof did not extend 3 feet or more above the roof. To abate this hazard, the employer must ensure ladders are extended at least 3 feet above the upper landing surface. Pursuant to 29 CFR 19103.19, the employer must submit documents describing the measures it tis taking to ensure compliance, including an explanation of how these steps will ensure that ladders used by employees for accessing roofs are extended at least 3 feet above the landing surface. Vicente Olmas Gayosso dba Vicente Olmas Gayosso was previously cited for a second repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1542443, citation number 1, item number 3a and was affirmed as a final order on 09/21/2021, with respect to a workplace located at 345 Taylors Way, Moody, AL.
