OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat. On or about September 28, 2021, and at times prior thereto, employees performing moderate category work tasks, such as constructing, installing and pounding stakes and boards for concrete formwork, were exposed to the recognized hazard of high ambient heat with a heat index of 98�F in direct sun during the performance of their job duties. Such exposures are likely to lead to the development of serious heat-related illnesses.
