29 CFR 1910.334(a)(2)(ii):There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made: Kitchen -In the following instances, the Somerset Industries CDR-2000LC pizza dough roller was defective and could have exposed an employee to injury: a) The On/Off switch was defective and was bypassed electrically so that the only way to shut the power off was to unplug the machine. b) The screws to the top, interlocked lid were stripped and would not hold the lid shut. The employer had two gallons of Barbecue sauce holding it down.
