Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Kronemann Construction, Inc. at 218 Railroad Street in New Effington, SD 57255: On or about and at times prior to January 27, 2021, the employer did not ensure employees were protected from fall hazards while using the hand elevator. Employees used a hand elevator to gain access to upper levels within the elevator that had an inoperable car safety that was not capable of stopping and sustaining the car. The hand elevator travels approximately 120 feet from the ground level to the head house. This condition exposed employees to a fall hazard of up to 120 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the American Society of Mechanical Engineers (ASME) Standard A17.1-2010/CSA B44-10, "Handbook on Safety Code for Elevators and Escalators." Section 4.3.15 states, "The hand elevator shall be provided with an operable car safety capable of stopping and sustaining the car with the rated load."
