Text For Citation: 01 Item/Group: 001 Hazard:

29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) Building 3 interior, east side, adjacent to overhead drive through door: A JLG 1930EX scissor lift being operated by an employee was struck by the a garage bay door causing the employee in the lift to fall out of the lift to the ground below. The employer did not ensure that precautions were taken such as, but not limited to, barricades to avoid all hazards where the work was taking place such as or not limited to the garage bay door opening. Occurred on or about 2/15/2021. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
