Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) Employees were exposed to struck-by hazards while working on the ground behind a Mustang Cat Model 305 excavator in wet and muddy conditions when the employer did not ensure that employees could safely move out of the path of a moving excavator. Among other methods, feasible and acceptable means of abatement may include: 1) Require employees working on the ground in the proximity of a moving excavator to maintain a safe distance from the machine. 2) Increase the distance between employees working on the ground and the moving excavator in adverse conditions, including but not limited to wet and muddy ground. 3) Require the operator to sound the horn and wait until the blind spots at the rear of the excavator are clear of personnel prior to moving an excavator in reverse. 4) Develop a written excavator operating procedures and train all operators and ground employees in the employer's written procedure. 5) Use a spotter to control the movement of the excavator.
