29 CFR 1926.1101(h)(2)(i):The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator: a) Exterior Rear of Single Family Frame Home: Transite asbestos panels, containing 15% chrysotile asbestos were removed by hand, using a flat bar tool, on a two story residential home. The employee was required to wear an N95 filtering facepiece respirator. The employer did not develop and implement a written respiratory protection program, on or about 9/15/20.
