OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to being run over or struck by Wheel Loaders being operated in a reverse direction in the yard. a) 2704 Geryville Pike; Pennsburg, PA Yard - On or about September 4, 2020, employees walking in the yard area are exposed to being run over or struck by Cat 938M Wheel Loaders that share the same roadway and are being operated in reverse out of aisles where the operator's vision is obstructed. Among other methods, feasible and acceptable methods of abatement would include: Implement an internal Traffic Control Plan to coordinate the flow of moving equipment, workers, and vehicles in the yard in order to minimize or eliminate vehicles and employee struck-by hazards. Elements of the Traffic Control Plan would include the following: 1) Ensuring the use of high visibility safety vests by all workers. 2) Enforcing specific speed limit throughout the yard area for all vehicles. 3) Posting additional speed limit signs in the yard as a reminder to vehicle operators to maintain the speed limit. 4) Ensuring that vehicles slow down and then stop and look prior to reversing into an intersecting vehicle path, signal using the horn, or utilize a spotter where the operator's range of vision is obstructed or limited due to blind spots. 5) Ensure that operators utilize the Wheel Loader 's back-up cameras. 6) Identify designated pedestrian walkways. 7) Providing supervisors, drivers, and laborers with training on the Internal Traffic Control Plan.
