29 CFR 1910.1200(e)(1): The employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) On or about July 16, 2020, and at times prior, the employer, DBS, Inc. dba Colorado Structural Repair, did not develop and implement a written hazard communication program that pertains to employee use of chemicals such as, but not limited to Mel-Prime: a chemical waterproofing agent which has a toluene concentration listed as 45%-50%. This condition exposed employees to chemical exposure hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
