OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. a. On and before March 10, 2020, the employer failed to fully train its employees on non-routine tasks and hazards associated with the setup and use of hydraulic equipment, such as the oversight and evaluation of the use of hydraulic equipment by contractors. Thereafter an accident occurred involving a contractor employee. Among other methods, feasible and acceptable abatement methods to correct the hazard are: to train employees to follow manufacturers' instruction for the setup, use, and maintenance of hydraulic equipment used by the employer.
