29 CFR 1910.1000(e): Feasible administrative or engineering controls are not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d) and protective equipment or any other protective measures are not used to keep the exposure of employee to air contaminants within the limits prescribed: or in the alternative Section (5)(a)(1): The employer failed to furnish to each of their employees employment and a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm, in that employees were exposed to hydrogen sulfide hazards. (a) On or about February 28, 2020 an employee lost consciousness when exposed to hydrogen sulfide above the maximum peak of 50 ppm while performing workover activities where engineering controls or protective equipment were not used to eliminate exposure at the Murex Petroleum wellsite, Murex Tank 12-35 located six miles south of Keene, North Dakota.
