29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE: On January 13, 2020, at the Dredge Wheeler at Dry Dock #1, Aft Port corner where a 5 X 5 hole was cut into the Poop Deck, an employee was sitting on top an I-beam without wearing or using fall protection, exposed to a fall hazard through the hole of approximately 18 feet, 10 inches.
