29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov: The employer is failing to ensure that employees are protected from the hazard of lack of injury and illness identification. This violation was most recently documented at a worksite located at or near 3400 S 204th St., Elkhorn, NE 68022 on or about December 2, 2019. The employer did not notify the OSHA Omaha Area office of an employee hospitalization that took place on November 26, 2019 within 24 hours of its occurrence. As stated in 29 CFR 1904.39 (a)(2), within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. In this case, the Area Office was notified of this incident on December 2, 2019. An employee was hospitalized when they fell from a manlift, causing broken ribs.
