29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: (a) On or 09/03/2019 - Wash Bay, the employer failed to develop and implement a written permit space program for entry into spaces, such as but not limited to, DOT 407 tanker LT122, exposing employees to confined space hazards including, but not limited to, low visibility, limited access, and oxygen deficiency.
