29 CFR 1910.176(a): The employer did not ensure that where mechanical handling equipment is used, sufficient safe clearances were allowed for aisles, wherever turns or passage must be made. Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked: (a)SpartanNash Associates, LLC at 1300 West Elkhorn Street, Sioux Falls, SD 57104: On or about and at times prior to May 6, 2019, the employer did not ensure employees were protected from struck-by hazards in that, aisle ways used by powered industrial trucks were not kept clear and free from obstructions. On May 6, 2019, an employee was severely injured when the powered industrial truck he was operating struck a pallet of merchandise that was protruding into the path of travel. The employee was pinned between the powered industrial truck and pallet racking storage system, causing internal bleeding and hospitalization. The condition exposed employees to struck-by and caught-in-between hazards.
