29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: a) At 8764 Rand Ave, Buildings 4 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Socios Atlanta Construction to operate pneumatic nail guns without eye protection while performing siding activities exposing employees to struck-by hazards. b) At 8764 Rand Ave, Buildings 6 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Jesus Rodriguez to operate pneumatic nail guns without eye protection while performing framing activities exposing employees to struck-by hazards. c) At 8764 Rand Ave, Buildings 9 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Joel Trigueres to operate pneumatic nail guns without eye protection while performing framing activities exposing employees to struck-by hazards. d) At 8764 Rand Ave, Buildings 5 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Jose Diaz to operate pneumatic nail guns without eye protection while performing roof decking activities exposing employees to struck-by hazards. e) At 8764 Rand Ave, Cabana Building Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Alfredo Santos Cruz to operate pneumatic nail guns without eye protection while performing framing activities exposing employees to struck-by hazards. THE GARCIA BUILDING CO., LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.102(A)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1226360, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 27, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 3810 BUCK LAKE ROAD, TALLAHASSEE, FLORIDA.
