29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: The employer is failing to have daily inspections conducted by a competent person to identify any factors which could result in a cave-in or other hazardous situations. The most recent occurrence was evident during the inspection conducted on April 9, 2019 at a worksite located at 410 E 8th St., Stromsburg, NE 68666. The employer does not have a trained competent person to perform daily inspections at the excavation site where he and one employee is working. This was evident by the number of violations observed and the fact that the side wall of the trench collapsed trapping the employee.
