29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. The employer is failing to protect employees from excavated materials that could pose a hazard by falling into excavations where employees are working. The most recent occurrence was evident during the inspection conducted on April 9, 2019 at a worksite located at 410 E 8th St., Stromsburg, NE 68666. The employer has a 50 foot long trench that varies from 7 to 9 feet in depth at the jobsite. The spoils piles are located along both sides of the trench. At various locations along the trench the spoils pile is not located at least 2 feet of the edge which poses a cave-in hazard.
