OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not develop and implement an adequate site-specific safety plan for safe movement of workers across active interstate highway lanes. a) On or about April 1, 2019, at the site location of the Indiana Avenue Projects I-75, Toledo, OH: An employees was crossing at posted 60 MPH highway in order to access to the median work zone from the Indiana Avenue work zone. An employee walking across the highway in this condition was struck by a passenger vehicle, sustaining serious injury. One feasible and acceptable method to correct this hazard is to develop and implement a site specific safety plan which as set forth in Section 6.5 (access and egress to work) of ANSI A10.47 - 2009, identifies explicit procedures for safe movement of workers across active highway lanes.
