OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from construction vehicles. a) On or about February 14, 2019, at the worksite located at 1102 Glynwood Road, Wapakoneta, OH: An employee was guiding a boring machine along a roadway to its next operating position. Another employee was backing up a vacuum truck along the same path as the boring machine. The vacuum truck struck the employee walking with the boring machine. Among other methods, one feasible and acceptable method to correct this hazard is to utilize ANSI A10.47 - 2009, American National Standard for Construction and Demolition Operations - Work Zone Safety for Highway Construction which states when backing a construction vehicle a mechanical backing assistive device, an audible back up alarm or a spotter shall be utilized to verify that the path is clear.
