OSH ACT of 1970 Section (5)(a)(1) Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act); The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer did not replace hydraulic hoses on a 2005 Fuchs MHL 360 (mobile hydraulic loader) since its purchase. The lack of maintenance to the hydraulic loading machine resulted in the hydraulic-powered cab-lift malfunction causing employee injury. An operator was injured when the cab-lift hydraulic system failed and the cab fell from an elevated height of 5-6 feet.
