29 CFR 1910.268(b)(8): Illumination of field work. Artificial illumination was not provided to enable the employee to perform the work safely when natural light was insufficient to adequately illuminate the worksite: (a)True North Tower, LLC at Tower/Project #CER1323012/SDL04621 154th Avenue, Rapid City, 57703: On or about and at times prior to January 10, 2019, the employer did not ensure employees were protected from hazards associated with inadequate lighting as a part of night climbing and performing night work on a telecommunications tower. On January 10, 2019, a tower tech/top hand employee fell approximately 180 feet and died as a result of injuries sustained from the fall. The employee was utilizing a JobSmart 250 Lumen Headlight while attempting to troubleshoot an Alpha 2100 radiohead. During the process of transitioning to the ladder and descending from the top of the tower, the employee fell. The single headlight did not provide an adequate level of lighting to the work area to ensure shadows were not created that could affect an employee's perception while working on the tower. The company did not have an established night work policy or a procedure to address the hazards of working at night. This condition exposed an employee to fall and struck-by hazards related to inadequate lighting associated with working on a telecommunications tower at night.
