29 CFR 1926.303(d): All abrasive wheels and tools used by employees did not meet other applicable requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels: At a worksite located 3119 to 3123 (Shankman Building) and 3125-3133 (Michaelson Building), Kansas City, MO 64109: Employees were exposed to struck-by hazards. The employer failed to ensure that a bench grinder was used in accordance with ANSI B7.1-1970, which states, " 4.4 Exposure Adjustment Safety~ guards of the types described in Rules 4.3.1 page 28 and 4.3.2 page 29 where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in Rules 4.3.1 page 28 and 4.3.2 page 29 shall never be exceeded and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed 1/4 inch. There was no tongue guard located on the bench grinder that was being used by employees to sharpen metal scrappers.
