29 CFR 1910.120(q)(6)(ii)(B): Employees who participated, or were expected to participate, in emergency response as first responders at the operational level could not objectively demonstrate how to select and use proper personal protective equipment provided to the first responder operational level: (a) 55 Hosier Street, Warehouse #1, Selbyville, DE - On or about July 12, 2018, the employer provided inappropriate respiratory protection to employees engaged in response activities due to an uncontrolled release of approximately 300 gallons of Peracetic Acid. Employees who were not knowledgeable in the selection and use of personal protective equipment to be worn for emergency response activities were provided with a dust mask while assisting with the containment of the hazardous substance. (b) 55 Hosier Street, Warehouse #1, Selbyville, DE - On or about July 12, 2018, the employer failed to ensure that employees engaged in response activities due to an uncontrolled release of approximately 300 gallons of Peracetic Acid selected and wore the appropriate level of personal protective equipment. Employees assisting with the containment of the hazardous substance were not provided with, nor did they wear, full-face respirators as required per the developed Emergency Response Plan for a greater than incidental release of Peracetic Acid.
