29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it was restored to safe operating condition. On or about May 06, 2018 at the jobsite located 2001 Premier Parkway, Saint Peters, Missouri, the employer did not ensure Raymond Reach-Fork and Deep-Reach Lift Truck with The ACR System (Model: 750-DR32TT; Serial Number: 750-17-BC57734) was free of defects and safe to drive before placing it into service. An employee sustained a broken arm resulting from an accident while operating the lift truck that had not been taken out of service after a previous malfunction that was not repaired.
