OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from moving vehicles: a. On or about May 1, 2018, on the shoulder of U.S. Interstate I-10, employees sitting in the bed and on the tailgate of pickup trucks while setting and retrieving traffic cones and signage used for effecting Maintenance of Traffic (MOT) plans for construction work were exposed to the hazards of falling from vehicles, in that they were not wearing seatbelts or protected by other means of restraint from falls or flail injuries in the event of a vehicle movements or crashes.
