29 CFR 1926.454(c): The employer had reason to believe that an employee lacked the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, and the employer did not retrain such employee so that the requisite proficiency was regained: On or about 04/16/2018, in the EDC Unit at Westlake Chemical, the employer did not ensure that a supported scaffold equipped with a knee-out was loaded in accordance with a qualified person's design, to the extent feasible, as it was being dismantled.
