Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: (a) Product Verification Center (PVC), Test Pad 7 - The employer did not protect employees, positioned within the striking distance of prototype lattice crawler cranes, including the Manitowoc MLC300 lattice crawler crane, known as Shop Order 6302, from the hazard of getting stuck-by crane components, in the event of prototype lattice crawler crane collapse or tip-over. On February 2, 2018, Shop Order 6302, sat on Test Pad 7 facing southward with the 275.6-foot long boom at an angle of approximately 81.6 degrees and the 275.6-foot long luffing jib at an angle of approximately 50.7 degrees, with no loads on the lifting points but with lower load blocks raised above the ground, and with Shop Order 6302 subject to winds exceeding 35 mph while employees worked inside or just outside of the Test Pad 7 Technical Control Room, located within 200 feet of Test Pad 7. Shop Order 6302's boom and luffing jib collapsed in 40 mph wind, and collapsing crane components struck three employees trying to escape, resulting in these employees' deaths. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
