29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a)List Electric, Inc. at 29758 426 Ave., Scotland, SD 57059: On or about and at times prior to November 2, 2017, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his environment to control or eliminate any hazards or other exposure to illness and injury. On November 2, 2017, an employee was seriously injured as a result of a struck-by and a caught-in-between hazard involving an employees' head being pinned between a structural steel rafter and the operators panel of the aerial lift. The employee was not provided appropriate training to recognize the hazard posed by elevating and moving the aerial lift. This condition exposed an employee to struck-by hazards. Abatement Note: Only trained and authorized persons are allowed to operate an aerial lift. Training should include: 1. Explanations of electrical, fall, and falling object hazards; 2. Procedures for dealing with hazards; 3. Recognizing and avoiding unsafe conditions in the work setting; 4. Instructions for correct operation of the lift (including maximum intended load and load capacity); 5. Demonstrations of the skills and knowledge needed to operate an aerial lift before operating it on the job; 6. When and how to perform inspections; and 7. Manufacturers requirements.
