OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that that forklifts were being operated without the use of the seatbelt, thus exposing employees to struck-by hazards and crushed-by hazards: a) Throughout Facility - On or about October 24, 2017 and times prior to, employees were exposed to hazards associated with being crushed-by or struck-by a powered industrial truck (forklift) if they were to be ejected due to not being restrained while operating the forklift.
