29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) A kitchen cook was exposed to continuous noise levels at 158.4% of the permissible daily noise exposure or an equivalent sound level of approximately 93.3 dBA during the 385 minute sampling period on 10-19-17; exposure calculations included a zero increment for the 95 minutes not sampled. b) A kitchen cook was exposed to continuous noise levels at 157.6% of the permissible daily noise exposure or an equivalent sound level of approximately 93.2 dBA during the 390 minute sampling period on 10-19-17; exposure calculations included a zero increment for the 90 minutes not sampled. c) A kitchen cook was exposed to continuous noise levels at 110.8% of the permissible daily noise exposure or an equivalent sound level of approximately 90.7 dBA during the 427 minute sampling period on 10-19-17; exposure calculations included a zero increment for the 53 minutes not sampled.
