29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: (a) On or about May 31, 2017, the employer failed to evaluate the workplace to determine if any spaces were permit-required confined spaces, in that, employees were required to work at the plane, and break the plane of, tanker trailers identified as confined spaces and having the potential for hazardous atmospheres including hydrogen sulfide gas. A system for evaluation of confined spaces, as well as a permitting and labeling system was not in place at the time of the inspection. Employees were exposed to serious hazards associated with toxic atmospheres.
