Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries and/or death: (a) 14th Street, Altoona, PA; On or about August 4, 1998, a Ford truck, PA license #ZJ61723, with Leach Packmaster refuse equipment, had an obstructed view to the rear and the back up alarm was inoperable. In addition, a preventative maintenance program based upon the manufacturer's recommendations was not being conducted as evidenced by; no brake lights, no low beam head lamps, loose driver's side back-up mirror obscuring vision due to excessive vibration, a cracked side step grab bar, and a discharged fire extinguisher. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair all deficiencies on the vehicle and to implement a preventative maintenance program based upon the American National Standards Institute, ANSI Z245.1, "Safety Requirements for Mobile Refuse Collection and Compaction Equipment and the service manual for Leach Packmaster Refuse Equipment.
