29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: (a) Mixing area- On or about May 11, 2017, and at times prior, safe permit required confined space entry procedures were not developed or fully implemented for employees entering chemical mixing tanks for cleaning purposes. Deficiencies included, but were not limited to the following: 1) Lack of a written permit required confined space entry program; 2) Lack of the identification and evaluation of the hazards of permit spaces before employees entered them; 3) Lack of designated persons who are to have active roles (as, for example, authorized entrants, attendants, entry supervisors, or persons who test or monitor the atmosphere in a permit space) in entry operations; 4) Lack of a system for the preparation, issuance, use, and cancellation of entry permits; 5) Lack of procedures for summoning rescue and emergency services and/or for rescuing entrants from permit spaces; 6) Lack of permit required confined space entry training for all employees who have active roles.
